Booking Terms and Conditions

1. Your Contract

The application for the booking constitutes an acceptance of all these terms and conditions by the client and the client accepts it on behalf of all the members of the party named in the booking form. The booking terms and conditions form the sole contract between Mr Jonathan Shields and Mr Shaun Armstrong (referred to as we) and the person signing the booking form, who must be over 25 years of age and who shall be deemed to sign the form on behalf of all the persons herein. No contract shall exist until we have received a signed booking together with the correct “booking deposit” and/or “full payment” and we have confirmed the reservation in writing.

2. Payment

In order to book the villa, we require a non-refundable deposit of 150 ($240) per week. The balance will be due 8 weeks before departure. If the balance is not paid on the due date we reserve the right to treat the booking as cancelled. A damage deposit of 250.00 ($400) is required at the time of booking. This will be returned to you after our management company's satisfactory report after your departure. A “security deposit” is used to cover excessive use of electricity (e.g. air condition on full with external doors left open), excessive cleaning costs, and also covers for damage, breakage and loss to any of the villa's contents. The “security deposit” less any such charges will be refunded by cheque, as soon as the Management Company has completed its inventory and occupancy report. Usually refunded on the 18th day of the following month after your departure from the villa. Renters are liable for all damage and loss to the villa during their stay. We and our agents reserve the right of entry at any time.

3. Cancellation

You may cancel your holiday at any time providing that the cancellation is made by the person signing the booking form and is communicated in writing. The following cancellation charges will apply.

4. Changing your Booking

If, after confirmation has been issued, you wish to change departure dates, we will do our best to help. If we are unable to rearrange your booking we reserve the right to treat the booking as cancelled.

5. Accommodation

The accommodation is provided solely for the use of the client and guests named on the booking form or as amended by agreement with us in writing. Subletting and/or reassignment is strictly prohibited. No clothing, bedding or similar items shall be dried or aired in the outdoor area. Check in time is not before 16.00 hours local time on the day of arrival. Check out time is 10.00 hours local time on the day of departure (Please note that a late departure fee will be made after this time). The whole of the villa is designated as a non-smoking for safety, comfort and legal reasons. Lawn and pool care are provided on a weekly basis. Please note that each villa has an initial supply of consumables (bin bags, toilet rolls, washing powder, etc.). Once these have been used it is NOT the responsibility of the Management Company to replenish these items during your stay. The consumables supplied vary from villa to villa and should be adequate for the first few days of your stay. As Florida has a tropical climate, insects including ants and the like are occasionally inevitable, and these are not cause for complaint. The villas are all treated regularly by a pest control program and cleaned professionally between each rental. All trash/garbage must be put out for collection by the sidewalk/footpath early on the collection days as designated in your villa manual. Excess trash/garbage left on the departure day will be charged to clear.

6. Insurance

It is your responsibility and a condition of the booking that you arrange appropriate insurance cover for all members of your party for personal injury etc. We assume that such policy is in force before you depart. All members of the party who use the pool/Jacuzzi do so entirely at their own risk. Please obey the pool/Jacuzzi rules and remember at all times that this is a private pool with no lifeguard. Please also note that the wet areas around the pool and the ceramic tiles can be slippery so please ensure that you or members of your party are dry before entering the villa from the pool area.

7. Reductions

No reductions will be given under circumstances amounting to “force majeure”. In the above a “force majeure” means: war, threat of war, riot, civil strife, industrial dispute, terrorist activity, accident, natural disaster, fire, airline failure, closure of airports or ports and adverse weather condition or temporary pest problems at and around the villa or any other event, situation, incident, and natural causes outside our control.

8. Care of Property

Please remember that this is someone's privately owned villa and for which you, as a party leader, take and accept full responsibility. You are also responsible to leave it clean and undamaged. The property will be thoroughly examined by the management company and an inventory taken on your departure and if it is not left in a suitable condition, it may be necessary to not only charge the security deposit for costs to cover extra cleaning, repairs or replacements but also to pursue you for any additional costs incurred. We also recommend you inspect the villa on arrival to ensure it is in order and to point out any possible defects to the Management Company immediately on arrival. We cannot accept liability for failure of public supplies such as water, electricity, gas supplies or air conditioning supplies or of pool heaters. Nor for the consequences of the actions or omissions that may supply or control main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control. Any failure will be dealt with urgently by local engineer. This does not affect your statuary rights as a consumer.

9. Liability Limitations

  1. Please note that no responsibility is accepted for any loss of personal items while staying in the property or after departure
  2. The owners or their agents will not be liable for any loss or injuries resulting from use of the villa, pool or any part of the property howsoever caused. All guests must follow the rules and notices of safety matters.
  3. Parents must at all times obey the rules and supervise children when using pool facilities or estate facilities.
  4. It is Florida State Law that the patio door alarms are kept on at all times for safety of children.
  5. Owners of the Management Company accept no responsibility or liability for failure of any equipment in the villa. After notification of equipment failure, the Management Company will endeavour to rectify the problem in a reasonable and timely manner and do their best to fix the problem. You accept as part of our terms and conditions that we are not liable for any delay, howsoever caused, in fixing any such problems and that once the relevant company has been instructed we can not make any warranties concerning the timing to fix these. We cannot accept any liability for your personal safety during your holiday vacation. You are reminded to exercise care as to your personal safety, and the safety or your companions. Use of the pool and any community pool, aqua area, tennis court and recreation area is entirely at your own risk. It is particularly important that children are supervised at all times in and around the pool areas, the pools are between 3 and 6 feet deep. Lakes and wetland areas can be very dangerous; children should always be accompanied by an adult. For your children's safety, all villa to pool doors are alarmed, tampering or disconnection of these devices is a criminal offence.

10. Agreement for the following Conditions of use of Equipment

  1. Air conditioner setting must be at a minimum of 75 degrees. Any lower setting could damage the unit and repairs/replacements will be charged back to you.
  2. The pool/Jacuzzi heater operational procedures must be followed for safety and your comfort.
  3. Please follow instructions on operation/safety procedures on all the equipment in the villa. If in doubt ask.
  4. Please note that it is your responsibility to ensure the villa is locked with the alarm activated, and lighted suitably when the villa is unoccupied. To familiarise yourself with the alarm’s opertion, please refer to the Tŷ Seren manual provided within the home. This is for your own security and safety.
  5. Please note that our drive is only meant for small light passenger cars and is not built to take the weight of any large or heavy vehicles, e.g. buses, trucks, vans or extremely large SUVs. These are not allowed on the drive as they may cause damage. Please note that any damage caused to the drive by any vehicles will be charged back to you.

11. Descriptions

All descriptions given on the website are made in good faith, no liability can be accepted for error or omissions. The owners and management reserve the right to change room configuration, appliances, furniture, furnishings, and games equipment without notice.
